Maintaining consistency with the ACL

The Intergovernmental Agreement for the ACL provides that the Commonwealth, States and Territories endeavour to repeal, amend or modify any legislation that is inconsistent with or alters the effect of the ACL.

A principles-based Guide [PDF 399KB] has been developed to assist Commonwealth, State and Territory agencies to identify inconsistent, complementary or duplicative provisions in new legislation and existing legislation under review. It seeks to assist jurisdictions when engaging in the review or the development of legislation.

The Guide also includes a suggested Assessment form [DOCX 57 KB | PDF 126KB] that jurisdictions may wish to use when assessing new or existing legislation against the ACL.

A general overview of the ACL framework, The Australian Consumer Law: A Framework Overview is also available on the legislation page as a practical aid to understanding the ACL.
