On 11 May 2009 the former Assistant Treasurer and Minister for Competition Policy and Consumer Affairs, the Hon Chris Bowen MP, released for public consultation, a consultation paper entitled The Australian Consumer Law: Consultation on draft provisions on unfair contract terms.

This consultation closed on 22 May 2009.

Standing Committee of Officials of Consumer Affairs' information and consultation paper

On 17 February 2009, the Standing Committee of Officials of Consumer Affairs (SCOCA) released an information and consultation paper entitled An Australian Consumer Law: Fair markets — Confident consumers.

The Productivity Commission's review of Australia's consumer policy framework

The new consumer policy framework agreed to on 2 October 2008 by the Council of Australian Governments (COAG) draws on the Productivity Commission's (PC) 2007‑2008 Review of Australia's Consumer Policy Framework.

In conducting the review, the PC consulted widely with public and industry stakeholders, and in doing so received many views on the potential for regulation.
